These Terms of Sale ("Terms") govern all purchases made through boutiquecroatianwines.com, operated by Boutique Croatian Wines LLC ("BCW," "we," "us," or "our"), holder of Ohio C-2 Liquor Permit No. 10012077-4.
1. Eligibility
By placing an order, you represent and warrant that you are at least 21 years of age, are legally permitted to purchase alcoholic beverages, are an Ohio resident or are shipping to a valid Ohio address, and have provided truthful and accurate information at checkout.
2. Ohio-Only Sales & Shipping
BCW currently sells and ships only within the State of Ohio. Orders with shipping addresses outside Ohio may be cancelled and refunded. BCW does not ship wine outside Ohio at this time. In accordance with Ohio law, no sales are made on Sundays: orders cannot be completed through the website on Sundays, and in-store pickup transactions are not conducted on Sundays. Orders may be placed Monday through Saturday. In-store pickup occurs during posted pickup windows — currently the first Monday of each month, Noon to 3 PM.
3. Age Verification
BCW requires age verification at checkout. Delivery also requires an adult signature from a person 21 years of age or older with valid government-issued photo identification. The carrier may refuse delivery if an eligible adult is not available.
4. Products & Pricing
All product descriptions, vintages, pricing, and availability are subject to change without notice. All prices are listed in U.S. dollars and are intended to comply with applicable Ohio alcohol pricing and markup requirements. We reserve the right to correct pricing errors, cancel orders, or refuse fulfillment where required by law or business necessity.
5. Payment
Payments are processed securely through Stripe. Your payment card is charged at the time your order is placed. BCW does not store full credit or debit card numbers on its servers.
6. Taxes, Shipping Charges & Fees
Applicable sales, excise, shipping, and handling charges are calculated at checkout. Shipping charges may vary based on promotions, order value, or approved checkout codes used for internal/in-store processing.
7. Title & Risk of Loss
Title to all alcoholic beverages passes to the buyer in the State of Ohio at the time of sale.
Risk of loss may transfer once the order is tendered to the carrier, subject to any replacement or refund rights stated in these Terms or our Shipping Policy.
8. Shipping & Delivery
Orders ship via UPS, FedEx, or another approved carrier as available. Alcohol deliveries cannot be left unattended, at a doorstep, with a minor, or without proper age verification. Delivery to a business address is recommended when a qualified adult may not be home during the day.

9. Weather Holds
Wine is temperature sensitive. BCW reserves the right to delay shipment during periods of extreme heat or cold, including when temperatures may exceed approximately 90°F or fall below approximately 25°F along the shipping route. Weather holds are used to help protect product quality.
10. Order Cancellation
Orders may be cancelled before shipment for a full refund. Once an order has shipped, cancellation may not be possible. BCW may cancel or refuse orders due to suspected fraud, age verification concerns, incorrect pricing, inventory shortages, compliance restrictions, or other legitimate business reasons.
11. Returns, Refunds & Damaged Shipments
Because wine is an alcoholic beverage and temperature-sensitive product, returns are limited. Opened bottles are not returnable. Damaged or incorrect shipments must be reported within 48 hours of delivery with photos of the packaging, shipping label, and affected bottle(s). BCW may replace, refund, or otherwise resolve qualifying issues at its discretion.
12. Buyer Compliance
By placing an order, you agree that wine purchased from BCW is for personal use and not for resale unless otherwise authorized by law. You agree not to provide purchased alcohol to anyone under 21 years of age.
13. Website Content
Product descriptions, tasting notes, pairings, and other content are provided for informational purposes and may reflect subjective characteristics of wine. Images are representative and may vary by vintage, bottle, label, or availability.
14. Limitation of Liability
To the maximum extent permitted by law, BCW's total liability for any order shall not exceed the amount paid for the order giving rise to the claim. BCW is not liable for indirect, incidental, special, consequential, or punitive damages.
15. Dispute Resolution
Any dispute arising from these Terms or a purchase from BCW shall be governed by the laws of the State of Ohio. Venue for any permitted court proceeding shall be in Lake County, Ohio, unless applicable law requires otherwise.
16. Changes to These Terms
BCW may update these Terms from time to time. Continued use of the website or placement of an order after changes are posted constitutes acceptance of the updated Terms.
